Former Chief Justice Torkornoo Challenges Removal from Supreme Court in High Court

Former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo has filed an application for judicial review at the High Court, contesting her recent removal as a Justice of the Supreme Court by President John Dramani Mahama.

Through her counsel, Justice Torkornoo argues that the President acted beyond his constitutional authority when he issued a removal warrant on September 1, 2025, stripping her of both the Chief Justice role and her seat on the Superior Court of Judicature.

The application contends that the procedure outlined in Article 146 of the 1992 Constitution which requires an inquiry by a constitutionally mandated body before a Superior Court judge can be removed was not followed.

Justice Torkornoo is seeking several key declarations, including:

  • That the President lacks the authority to remove a Justice of the Superior Court without due constitutional process.

  • That only a body established under Article 146(4) has jurisdiction to hear any petition for removal of a Superior Court judge.

  • That the President’s removal warrant is “unlawful, null, void, and of no effect.”

Filed as The Republic v. Attorney-General, Ex Parte Justice Gertrude Araba Esaaba Torkornoo, the case cites Articles 23 and 141 of the Constitution and Order 55 of C.I. 47.

Legal analysts say the challenge will test the limits of presidential power over judicial appointments and could have significant implications for the independence of Ghana’s judiciary and the country’s constitutional governance.
